By booking a tour you acknowledge that you have read, understand and agree to be bound by these Terms. These Terms, together with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with us. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your group. Furthermore, you consent to the Tour Operator’s use of your personal data and you are authorised on behalf of all participants in your group to disclose their personal details to the Tour Operator, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements).

1. TOUR OPERATOR

The Tour Operator is “Warsaw Behind the Scenes Marcin Grabowski” and this company will issue the invoice.

2. PAYMENT

Warsaw Behind the Scenes tours and services must be prepaid in full price using options available on the website www.warsawscenes.com. Other payment options are available such as bank transfer. In this case the Tour Operator issues an invoice. By making a payment you confirm to agree to these Terms and Conditions.

3. CANCELLATION

You may cancel your booking by notifying the Tour Operator. Cancellation fees, if any, will be determined with reference to the date on which notice of cancellation is received by the Tour Operator and are expressed as a percentage of the total price paid for the cancelled tour or service.

Cancellation of the Tour for small groups (up to 15 persons):

• Up to 24 hours prior to the Tour start: 100% of the price is refunded
• 24 hours or less prior to the Tour start: 0% of the price is refunded
• No shows on the Tour: 0% of the price is refunded

Cancellation of the Tour for big groups (more than 15 persons) and/or when the price for the tour is EUR 1200, or equivalent in other currency, and higher:

• Up to 14 days prior to the Tour start: 100% of the price is refunded
• 13 to 7 days prior to the Tour start: 50% of the price is refunded
• 6 days or less prior to the Tour start: 0% of the price is refunded
• No shows on the Tour: 0% of the price is refunded

For certain tours or services offered by the Tour Operator, alternative cancellation terms may apply. The Tour Operator will advise you of any such requirements prior to confirmation of the applicable booking.

The Tour Operator guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour and itinerary information is available on the Tour Operator’s website or by contacting the Tour Operator. 

If the Tour Operator must cancel a tour for any other reason, the Tour Operator will refund all payments received.

4. RESPONSIBILITY

The Tour Operator shall assume no responsibility for accidents or damages beyond the control of the Tour Operator occurred during the tour or services. In such case the participant does not place any responsibility at the side of the Tour Operator and shall abandon any claims on the Tour Operator for any accidents, damages or injuries occurred during the tour or service.

5. ALLERGIES, FOOD AND HEALTH  RESTRICTIONS

Our booking form includes a section allowing for entering information about allergies, food and health restrictions of customers booking a tour or service. Please remember to mention allergies, dietary and health restrictions of all people you are booking for. If you are booking outside of our online system, please inform the Tour Operator about food allergies or dietary and health restrictions in your group. If the Tour Operator is unable to cater for a particular requirement, he will inform you via email, cancel your booking and refund 100% of payment. Please note the Tour Operator is only able to cater for food allergies and certain dietary restrictions (e.g. religious) but not food preferences.

6. TOURS AND SERVICES SAFETY

The participant, on behalf of his/ herself and/or any person or entity acting through or on behalf of participant, fully comprehends and accepts all of the risks associated with his/ her participation in the tours or services including exposure to unfavorable weather conditions, food sickness, injuries (e.g. those arising out of self-inflicted accidents or mishaps, other participants, automobiles, pedestrians and the like). If the guide responsible for the tour/service shall consider the participant to be unreliable or otherwise inept for the tour/service (drunk, aggressive, behaving in a way making continuation of the tour/service difficult or impossible etc) he/ she may refuse to accept the participant on the tour/service or ask the participant to leave the tour/service. The refusal for safety reasons is not grounds for a refund.

7. CLASSIC RETRO MINIBUSES and BUSES

Some of the retro minibuses and buses used on tours/ services are not equipped with seatbelts, which is legal in Poland. Classic retro minibuses and buses are not equipped with air-conditioning. 

8. MEETING POINT

The meeting point for the tours depends on the type of tour/ service and is agreed and described in email correspondence. In case of tours/ services that include transportation, pickup point will be agreed upon in email correspondence and present on the ticket.

9. PUNCTUALITY

Please be punctual for the tour/ service. In case of problems with locating our guide or any other reason for running late, please call our office at +48 22 247 83 31 or +48 605 278 289. In case of slight delay (up to 5 minutes past the set start time), a guide will wait for the participants at the meeting point. If the delay is longer than 5 minutes, the tour will start without you and we will direct you to the first tour location where you will be able to join the group. In case of running late and lack of contact, the tour guide shall consider the situation as “no show” and your reservation will be cancelled. Please note running late is not grounds for a refund.

10. WEATHER

Our tours/ services run regardless of the weather conditions. Bad weather conditions are not grounds for cancelling the tour/ service. Please wear appropriate clothes. No refund is available if you decide not to take the tour/ service because of unfavorable weather conditions.

11. BIKE TOURS SAFETY

The participant, on behalf of his/herself and/or any person or entity acting through or on behalf of the participant, confirms he/ she can ride a bicycle. Drinking alcohol just before or during the tour is forbidden. If the guide responsible for the tour shall consider the participant to be unreliable or otherwise inept for the tour (visibly unfit, drunk etc) he/ she may refuse to accept the participant on the tour. The refusal for safety reasons is not grounds for a refund. The participant confirms that he/ she has familiarized himself/ herself with the Polish applicable traffic rules.

11. MINIMUM HEIGHT OF PARTICIPANTS OF THE TOUR

Tours and Services which use retro cars and minibuses are available only for persons (adults, kids, children etc) taller than 150 centimetres (4,9 ft). This rule does not apply to tours/services with buses (more than 8 seats) and modern cars.
